1. Introduction

Welcome to Sunset Drive Limited ("Sunset Drive", "we", "our", or "us"). These Terms and Conditions govern your use of our vehicle hire and rental services in Kenya. By making a booking with us, you agree to these terms.

2. Eligibility

  • You must be at least 23 years of age to rent a vehicle.
  • You must hold a valid driving licence applicable to the vehicle category rented.
  • Foreign nationals must present an International Driving Permit (IDP) in addition to their home country licence.
  • You must present a valid national ID or passport at the time of vehicle collection.

3. Booking & Payment

  • All bookings are subject to vehicle availability and confirmation by Sunset Drive.
  • A security deposit is required at the time of vehicle collection. This will be refunded within 7 working days after return, subject to the vehicle being returned in the same condition.
  • Prices are quoted in Kenyan Shillings (KES).
  • Payment methods accepted: M-Pesa, bank transfer, cash, and credit/debit cards.
  • Bookings are confirmed only upon full payment or explicit written agreement otherwise.

4. Cancellation Policy

  • More than 48 hours before pickup: Full refund minus 5% processing fee.
  • 24–48 hours before pickup: 50% refund.
  • Less than 24 hours before pickup: No refund.
  • No-shows are treated as less than 24-hour cancellations.

5. Vehicle Use

  • Vehicles may only be driven within Kenya unless prior written consent is obtained.
  • Smoking, transporting illegal substances, or using the vehicle for any illegal activity is strictly prohibited.
  • Vehicles must not be used for sub-hire or commercial transportation without written consent.
  • Off-road use (except designated safari vehicles) is not permitted.
  • Mileage limits apply where specified. Excess mileage charges will be deducted from the security deposit.

6. Insurance & Liability

All vehicles are comprehensively insured. However, the renter remains liable for:

  • The agreed excess/deductible amount in the event of an accident.
  • Damage caused by negligence, drunk driving, or violation of these terms.
  • Loss of or damage to personal belongings left in the vehicle.
  • Traffic fines, parking charges, and toll fees incurred during the rental period.

7. Accidents & Breakdowns

In the event of an accident, the renter must: (a) not move the vehicle unless necessary for safety; (b) obtain names and contact details of all parties involved; (c) report to the nearest police station and obtain a police abstract; (d) notify Sunset Drive immediately on +254 143 949 266.

8. Return of Vehicle

  • Vehicles must be returned at the agreed time and location.
  • Late returns will be charged at the daily rate pro-rated per hour.
  • The vehicle must be returned with the same fuel level as at collection.
  • A refuelling charge of KES 500 plus the cost of fuel applies if the tank is not full (where applicable).

9. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
